Notifying the Local Authority of a leadership vacancy

Last updated on 14 November 2023

School Staffing Regulations for maintained schools

This is a reminder of the requirement in The School Staffing (England) Regulations 2009 (legislation.gov.uk) for maintained schools to notify the local authority of any Headteacher or Deputy Headteacher vacancies.

The regulations state that:

15.—(1) The governing body must notify the authority in writing of— (a)any vacancy for the head teacher; and (b)any post for a deputy head teacher which it has identified as one to be filled.

In response to feedback from some of our schools who were unsure how to do this, a new page has been created on The Grid to facilitate the process. You will find the new page under Human Resources/ Recruitment:

Hertfordshire headteacher or deputy vacancy notification to the Local Authority

Please use this form to notify Hertfordshire County Council of any Headteacher of Deputy Headteacher vacancy arising at your school.

For headteacher vacancies only, the governing board must also provide the Local Authority with the names of all shortlisted candidates. Where a school is supported by HFL in the recruitment process, we will do this for you. However, where a school is conducting headteacher recruitment without support from HFL, governors will need to provide the information directly.

Should you need any support with your recruitment, or help with notifying the local authority, please do not hesitate to contact us on leadership.recruitment@hfleducation.org or telephone 01438 544476.
